Mitchell advises clients in all aspects of commercial and residential real estate, with an emphasis on commercial leasing, both in New York City and nationally. He has extensive experience representing tenants and landlords in retail and office leases, and his tenant-side clients include numerous well-known global apparel and fashion brands and retailers. For several of these clients, Mitchell has managed, coordinated, and supervised all legal aspects of their nationwide retail leasing programs. As a result, Mitchell has established long-term relationships with virtually all the big-name national outlet and full price landlords and developers. These connections result in respectful negotiations which conclude transactions on a timely basis, and in a manner which promotes on-going business relationships between tenant/clients and their landlords.

Mitchell’s representation includes the negotiation of leases in shopping centers, malls, outlets, lifestyle and strip centers, street locations (including “flagship” locations), and warehouse and distribution facilities, as well as offices and showrooms throughout the United States. Mitchell has worked closely with his clients to assist them in dealing with the impact of the COVID-19 Pandemic; helping them to negotiate, structure, and implement agreements for rent relief, restructuring existing leases, and when necessary, working out early surrenders and lease terminations.

A significant portion of Mitchell’s practice involves the review and negotiation of other commercial real estate related contracts and agreements, including subleases, license agreements for temporary or pop-up retail space, surrender agreements, shop-in-shop agreements, brokerage agreements, construction contracts, and architect agreements.

As part of Mitchell’s practice, he handles the sale and purchase of co-ops, condos, and single-family homes (as well as seasonal and long-term rentals of condos and houses) in the New York City area and in the Hamptons. He also provides advice and counsel in the areas of general business and corporate law, employment, intellectual property, and commercial and civil litigation.

Mitchell is Of Counsel to Olshan Frome Wolosky LLP, a leading New York law firm with expertise in a wide range of practice areas. Mitchell's affiliation with Olshan, as well as the strong relationships he has with other prominent attorneys with who he collaborates, allows him to help meet all of his clients’ legal needs.

Mitchell has been consistently named to the New York Super Lawyers list, a Thomson Reuters rating service, since 2006. Lawyers are selected for inclusion on the list through a combination of peer nomination, peer evaluations, and independent research.

Mitchell has made several appearances on national television as a legal expert on CNBC, and he has served as a business and legal consultant to ABC News’s “20/20”. Mitchell is the author of the book Buy Your Own Business: The Definitive Guide to Identifying and Purchasing a Business You Can Make a Success, published by Simon & Schuster on how to become an entrepreneur in the 21st century. He was also a contributing author and small business editor for Beat the System, a consumer, legal and business book published by Rodale Press. Mitchell has written extensively on issues involving real estate, business, and personal finance for several major publications, including New York Magazine, Working Woman and Personal Finance Magazine. Mitchell wrote numerous articles for would-be and established entrepreneurs and small business owners, and was the small business and legal affairs editor for AT&T Small Business Solutions, a quarterly journal published by Business Week for AT&T.

Mitchell attended the University of Miami School of Law, where he was the Publications Editor of the Inter-American Law Review, the Managing Editor of the Entertainment and Sports Law Journal, and was selected to be a member of the Bar and Gavel Society and the Honor Court.
